Murder

The most serious of all offences. It occurs when a person of sound mind unlawfully kills another. To be convicted the prosecution must prove that the suspect had the intention to kill or cause grievous bodily harm. The suspect must know that their actions would kill the person or cause a very serious injury.

If found guilty the suspect will face a life sentence with the minimum tariff set by the trial Judge. This means the Judge will decide when the suspect can apply to be released from prison.

Defences
There are full defences to murder:
1. Non-participation
2. Self-defence
If proven, it is likely that the suspect would be found not guilty.

However, there are some defences which, if proven, would lead to a finding of not guilty to murder but guilty to manslaughter. These include:
1. Diminished responsibility
2. Loss of control and
3. Killing in pursuit of a suicide pact

Some Notable Cases:
R v AAA (Operation Auchnarrow) 4 defendants charged with conspiracy to murder. Three victims stabbed and shot at close range. Drug and gang related offence.
We got our client bail, and he was found not guilty at the Central Criminal Court.

R v JM-a male juvenile charged with murder. The defendant made confessions on a phone call at YOI. Difficult and complex case due to client’s vulnerabilities and learning difficulties.

R v AG-manslaughter. Female initially charged with ABH, but the victim was found dead some days after the assault. The Prosecution case was that the injury inflicted by our client caused his death. Our experts convinced the Crown Court Judge that the case was too complex and therefore unfair to ask the jury to decided if she was guilty or not. Case dismissed.

R v WS-Murder charge. Gang related violence resulting in death of rival member. Forensics a key element in this case.

R v WM-charged under the Terrorism Act. Charged with assisting those who attempted to bomb the London tube trains. Very large and complex case.
